Terms and Conditions
Terms for the sale of BLACKOUTBOX packages and individually configured goods to consumers and businesses. Provider: Shervin Emanuel Sabai Kashani (BLACKOUTBOX), Jahnstraße 2, 53773 Hennef, Germany. As of: 13 September 2026.
1. Scope
These Terms and Conditions apply to contracts for the supply of goods and goods packages under the BLACKOUTBOX brand concluded between Shervin Emanuel Sabai Kashani ("Seller") and customers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. A business customer is a natural or legal person or a partnership with legal capacity acting in exercise of its trade, business, or profession when the contract is concluded.
The customer's deviating terms only become part of the contract if the Seller expressly agrees to them.
2. Subject matter and product concept
BLACKOUTBOX packages are stationary protection and supply systems for private or commercial use at the intended storage location. They are not intended as an evacuation backpack, shelter, ballistic protection system, or substitute for professional emergency response.
The specific scope of performance follows from the product description in effect at the time the contract is concluded, the individual offer, and, where applicable, an accompanying package, best-before, storage, or inspection overview.
For individually configured packages, the specific composition may differ from the standard configuration. Only the composition stated in the offer or order confirmation is binding.
3. Product presentation, enquiry, and formation of contract
Presentations and descriptions on the website are generally not binding offers but serve to inform and, where applicable, invite the submission of an order or enquiry.
Where the website only offers a "request consultation", "request quote", or comparable button, this does not create a purchase contract. The contract is only formed once the Seller makes a specific offer and the customer accepts it within the stated period, or once an explicit order confirmation is issued.
If an online ordering process with a payment-obligating order button is activated at a later date, the customer submits a binding contractual offer by completing that ordering process. The Seller may accept this offer by order confirmation, payment request, or shipment of the goods within the acceptance period stated in the shop or order confirmation.
Input errors can be corrected using standard browser and input functions before submitting an online order. The language of the contract is German, unless another contract language is expressly agreed.
4. Availability and changes to individual components
BLACKOUTBOX combines products from various manufacturers. The availability of individual brands or model generations may change.
A specifically agreed product will not be replaced with another product for consumers without consent where this would change material characteristics. For configurations described in expressly functional terms, the offer may specify that a functionally at-least-equivalent product may be used; this must be transparently agreed before the contract is concluded.
Changes required due to statutory safety requirements, recalls, or lack of market authorisation remain reserved; in such cases the customer will be offered a legally permissible solution.
5. Prices, VAT, and incidental costs
Prices stated when the contract is concluded are total prices including statutory VAT, provided the Seller is subject to VAT and nothing else is indicated. Where the small-business regulation applies, this will be indicated accordingly.
Shipping, freight, hazardous-goods, installation, or other additional costs are shown separately before the contract is concluded.
For individually configured packages, prices shown as "on request" are non-binding until a specific offer with scope of performance and final price is provided.
6. Payment terms
Available payment methods are shown before the contract is concluded or stated in the offer.
Where instalment payment or payment via an external payment service provider is offered, additional terms, creditworthiness checks, and fees of that provider may apply. There is no entitlement to a specific payment method.
7. Delivery, delivery area, and passing of risk
The delivery area, shipping method, and estimated delivery time are stated in the specific offer or ordering process.
For consumers, the risk of accidental loss or deterioration generally only passes upon handover of the goods to the consumer or a third party named by the consumer, unless otherwise required by law.
Special shipping and hazardous-goods regulations may apply to large energy systems, lithium batteries, fuels, or other goods requiring special transport. Delivery only takes place where the legal and logistical requirements are met.
8. Retention of title
The delivered goods remain the property of the Seller until the purchase price has been paid in full. Further security rights may be agreed individually with business customers.
9. Individual configurations
Where the customer requests a configuration deviating from the standard, the products, quantities, number of persons, supply duration, and optional components agreed are documented before the contract is concluded.
Simply choosing from predefined standard options does not automatically exclude the statutory right of withdrawal. A statutory exclusion due to customer specification only applies where the legal requirements are actually met in the specific case.
10. Shelf life, best-before dates, and maintenance logic
References such as "10 years", "up to 25 years", or "long-term supply" relate exclusively to those specific products for which the manufacturer or supplier states a corresponding shelf life or best-before date.
The best-before date of the goods actually supplied, the manufacturer information, and the prescribed storage conditions are decisive. An advertised possible preparedness horizon does not imply a blanket shelf-life guarantee for all components of a package.
Batteries, rechargeable batteries, medical products, filters, water, fire-safety products, and personal additions may have significantly shorter inspection, maintenance, or replacement intervals. The customer is obliged to observe the manufacturer information supplied.
11. Safety, medical devices, and intended use
BLACKOUTBOX does not replace medical diagnosis, treatment, or professional emergency care. Medical and safety-relevant products are to be used strictly as intended and in accordance with manufacturer instructions.
For products such as tourniquets, chest seals, AEDs, respiratory protection, water treatment, or heating and cooking devices, instruction, training, or a specific suitability assessment may be required or advisable.
Medicines or officially regulated preparations, in particular potassium iodide, may only be used in accordance with medical or official guidance.
Operating combustion devices or fuels in unsuitable indoor spaces can create fire, explosion, or carbon monoxide hazards. Manufacturer information and local regulations must be strictly observed.
12. Statutory warranty
Statutory warranty rights apply for consumers. Legally permissible deviating arrangements regarding remedy and limitation periods may be agreed with business customers; mandatory liability provisions remain unaffected.
13. Liability
The Seller is liable without limitation for intent and gross negligence, for culpable injury to life, body, or health, on the basis of an expressly assumed guarantee, and under mandatory statutory liability provisions, in particular product liability law.
For slightly negligent breach of material contractual obligations, liability is limited to foreseeable damage typical for this type of contract, to the extent legally permissible.
A limitation of liability does not apply where it would be legally impermissible.
14. Right of withdrawal
Consumers generally have a statutory right of withdrawal for distance contracts. Details are set out in the separate withdrawal notice.
15. Recalls and safety-relevant product information
If the Seller is informed by a manufacturer, an authority, or another competent body of a product recall or relevant safety information concerning a supplied component, the Seller will take the legally required measures and inform customers using the available contact details.
16. Applicable law
German law applies. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection of mandatory consumer-protection provisions of the state of their habitual residence.
17. Place of jurisdiction
Statutory places of jurisdiction apply for consumers. Where the customer is a merchant, a legal entity under public law, or a special fund under public law, the Seller's place of business may be agreed as the place of jurisdiction, to the extent legally permissible.
18. Consumer dispute resolution
The Seller is not obliged to participate in dispute resolution proceedings before a consumer arbitration board and does not take part in such proceedings.
The former EU Online Dispute Resolution platform was discontinued as of 20 July 2025 and is therefore not linked.
19. Final provisions
Should any provision of these Terms be or become invalid in whole or in part, the statutory provisions and the remaining provisions remain unaffected.
